ENGINEER REPORT

Engineer Report and Jorich Matamoras Subdivision Status

Tom Wilson presented his report dated December 27, 2013. Chairman Bechtel asked about the Jorich Matamoras Subdivision Plan; Tom Wilson indicated the report is complete and he intends to get the plan recorded. Solicitor Warshawsky stated he will provide copies to the landowners.

SOLICITOR REPORT

UDITO, Nuisances, DONCO Street Agreement, Funk Issue, Fire Service, Noise Petition

On UDITO, additional monies were found in an overflow account and a full-scale investigation was ordered; Susquehanna Bank froze Allen Shaffer's account disbursements pending litigation. For nuisances, the Board gave 220 N Second Street another month for cleanup, and voted 5-0 to drop charges against Mr. Hoover after the tank was removed. On DONCO, the Board voted 5-0 to reject Mr. Yoder's proposal to plow streets for payment, as the Solicitor found no legal authority under the Second Class Township Code. Regarding the Funk issue, a judge ruled the Funks had a prescriptive easement and imposed a maintenance agreement. The Fire Service Agreement automatically renews with no changes requested. On the noise petition, the LCB hearing officer's decision was written and will go before the full board on Wednesday.
